1. Required Georgia Equine Liability Warning
Under Georgia law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Chapter 12 of Title 4 of the Official Code of Georgia Annotated.
2. Acknowledgment of Risks
I understand that participation in activities offered by Master’s Touch involves inherent risks, including but not limited to:
Outdoor & Recreational Activities:
● Horseback riding and equine activities
● Playground use
● Mud kitchen
● Mini barn
● Gardening and farm chores
● Walking trails
● Creek play
● Garden pond access and activities
● Hayrides
● Children’s train ride
● Participation in camps, programs, and events
Animals:
● Interaction with animals, including but not limited to: horses, goats, donkey, dogs, cats, chickens, ducks, guinea pigs, and any other animals located on the property.
Environmental & Activity Risks:
● Slips, trips, and falls
● Uneven or slippery terrain
● Water hazards
● Weather-related hazards
● Animal behavior risks (biting, kicking, scratching, pecking, pushing, etc.)
● Equipment failure
● Allergic reactions
● Exposure to insects, plants, mud, and natural outdoor conditions
I understand that these risks may result in injury, illness, property damage, or death.
3. Assumption of Risk
I voluntarily choose to participate (or allow my child to participate) in activities at Master’s Touch, and I assume all risks associated with them, whether known or unknown.
4. Release of Liability
To the fullest extent allowed under Georgia law, I, on behalf of myself and my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and agree not to sue Master’s Touch, its owners, employees, volunteers, agents, and representatives for any claims arising out of participation in or presence at equine, animal, outdoor, or recreational activities on the property.
This includes injuries or damages resulting from inherent risks as defined in Georgia Code § 4-12-2.
5. Indemnification
I agree to indemnify and hold harmless Master’s Touch from any losses, liabilities, damages,
or legal costs arising from my or my child’s participation in activities, except where prohibited
by Georgia law.
6. Medical Treatment Authorization
In the event of an emergency, I authorize Master’s Touch to obtain medical treatment for myself or my child, and I accept financial responsibility for any resulting medical expenses.
